1. Acceptance of Terms

By accessing and using ActiveSkill ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and ActiveSkill. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 16 years old to use ActiveSkill. By creating an account, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into these Terms
  • All information you provide is accurate and complete
  • You will maintain the accuracy of such information

3. Account Responsibilities

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account

3.2 Prohibited Activities

You agree not to:

  • Share your account credentials with others
  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code, viruses, or harmful content
  • Scrape, crawl, or use automated tools to access the Service
  • Reverse engineer or attempt to extract source code
  • Resell or commercially exploit the Service without permission
  • Impersonate others or misrepresent your affiliation
  • Upload inappropriate, offensive, or illegal profile pictures
  • Create groups with offensive, discriminatory, or misleading names
  • Harass, bully, or intimidate other users through groups, leaderboards, or any other social feature
  • Manipulate leaderboard rankings through fraudulent activity or automated submissions

4. Service Description

ActiveSkill provides an interactive coding learning platform with the following features:

  • Structured coding courses and exercises
  • AI-powered code evaluation and feedback
  • Interactive AI tutoring and help system
  • Progress tracking and achievements
  • Practice mode with dynamic exercise generation
  • Profile customization including profile pictures
  • Social features including friend groups and invite-based group membership
  • Global and group leaderboards with shareable rankings
  • In-app notifications for achievements, leaderboard changes, and group activity

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

5. Subscription and Payment

5.1 Subscription Tiers

ActiveSkill offers three subscription tiers:

  • Free (Starter): Access to free courses, 8 daily practices (coding exercises and code puzzles combined), limited AI project messages, and limited lecture chat messages per day
  • Pro: 50 daily practices (exercises + puzzles), access to all courses (Python, JavaScript, SQL), and expanded AI tutoring
  • Elite: Unlimited daily practices, access to all courses, all AI-guided projects, and full AI tutoring and mentorship

Both Pro and Elite plans are available as monthly or annual subscriptions. Usage limits and included features are subject to change with 30 days' notice.

5.2 Payment Terms

  • Subscription fees are billed in advance on a recurring basis
  • All payments are processed securely through Stripe
  • You authorize us to charge your payment method for all subscription fees
  • Prices are subject to change with 30 days' notice

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial subscription periods
  • You retain access to premium features until the end of your paid period

6. Intellectual Property

6.1 Our Content

All content on ActiveSkill, including text, graphics, logos, courses, exercises, and software, is the property of ActiveSkill and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our explicit written permission.

6.2 Your Content

You retain ownership of any code or content you submit to ActiveSkill. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your submissions for the purpose of:

  • Providing the Service (code evaluation, feedback, progress tracking)
  • Improving our AI models and platform features
  • Generating anonymized aggregate statistics

We will never publicly share your code without your consent. Code submissions are processed through OpenAI's API subject to their Terms of Use and Privacy Policy.

6.3 Profile Pictures and Social Content

By uploading a profile picture, you confirm that you have the right to use the image and grant us permission to display it on leaderboards, group pages, and other social features of the platform. Profile pictures are resized and stored on our servers. You may delete your profile picture at any time through your account settings.

Group names you create are subject to content moderation. We reserve the right to remove or modify group names that violate our content guidelines.

7. User Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using ActiveSkill, you consent to the processing of your data as described in the Privacy Policy, including the use of third-party services (OpenAI, Stripe) as detailed therein.

8. AI-Generated Content and Feedback

ActiveSkill uses AI (powered by OpenAI) to generate exercises, evaluate code, and provide tutoring. You acknowledge that:

  • AI-generated feedback may occasionally contain errors or inaccuracies
  • Code evaluations are automated and may not reflect all aspects of code quality
  • AI responses should be used as learning aids, not as professional advice
  • We are not liable for any consequences resulting from reliance on AI-generated content

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTIVESKILL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR €100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless ActiveSkill and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, for conduct that we believe:

  • Violates these Terms or our policies
  • Is harmful to other users or the Service
  • Exposes us to liability
  • Is fraudulent or illegal

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service immediately ceases, and we may delete your data in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

For EU users: Nothing in these Terms affects your statutory rights as a consumer under EU law. Any disputes arising from these Terms or the Service may be brought before the courts of your place of residence.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ActiveSkill regarding the Service.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.
